These Terms of Service ("Terms") govern your access to and use of the services provided by 9TOP LLC ("Company," "we," "us," or "our"). By engaging with our website, software, or services, you agree to be bound by these Terms.
1. Description of Services
9TOP LLC provides business solutions including, but not limited to:
Internet service brokerage.
Marketing automation and CRM tools (via Lead Connector/Molina Tech Solutions).
Miss-call text back and automated reputation management.
SEO and digital consulting.
2. SMS and Communication
By providing your phone number, you expressly consent to receive communications from 9TOP LLC.
Consent: You agree to receive automated text messages (SMS/MMS) for appointment reminders, service updates, and marketing purposes.
Opt-Out: You may opt-out at any time by texting "STOP". After texting STOP, you will receive one final confirmation message.
Assistance: Text "HELP" for customer support or technical assistance.
Costs: Message and data rates may apply depending on your mobile carrier plan.
3. User Obligations and Conduct
You agree to provide accurate, current, and complete information when registering for services or booking appointments. You are prohibited from:
Using our automation tools for "spamming" or sending unsolicited messages in violation of the TCPA.
Attempting to reverse-engineer any proprietary workflows or software provided by 9TOP LLC.
4. Payments and Fees
4.1 Payment Terms: All fees are due at the time of purchase unless otherwise agreed upon in a written Statement of Work. For recurring subscription services, payments will be automatically processed on the monthly anniversary of the initial purchase.
4.2 Limited 7-Day Refund Window: We offer a strictly limited 7-day refund period starting from the date of the initial purchase.
Exclusion: This 7-day window does not include or extend from any "Free Trial" period. Once a paid transaction is processed, the 7-day clock begins.
Post-7 Days: After the 7th day, all payments are 100% non-refundable, including partial months or unused portions of a service.
4.3 Refund Requirements (Tangible Reason): Refunds are not granted for "buyer’s remorse" or a change in business direction. To be considered for a refund within the 7-day window, the client must provide a valid, tangible reason in writing. Tangible reasons are strictly limited to:
Service Non-Delivery: A major feature promised in the service agreement (e.g., the Miss-call text back system) was not delivered or made accessible within the agreed-upon timeframe.
Technical Failure: A critical software error on the part of 9TOP LLC that prevents the core service from functioning, which our technical team is unable to resolve within 72 hours of being notified.
Billing Error: Proof of an accidental double-charge or an incorrect tier placement.
4.4 Approval Process: All refund requests are subject to internal review and approval by 9TOP LLC. We reserve the right to deny refund requests that do not meet the "tangible reason" criteria or where significant labor (such as custom automation builds or SEO audits) has already been performed.
5. Limitation of Liability
This is a critical legal protection for your business: 9TOP LLC provides "as-is" services. We are not liable for any indirect, incidental, or consequential damages arising from:
Downtime of third-party software (e.g., GoHighLevel, Twilio, or ISP providers).
Lost revenue due to missed calls, failed automations, or fluctuations in search engine rankings (SEO).
Errors in data provided by the user. In no event shall 9TOP LLC’s total liability exceed the amount paid by you for the specific service in the preceding 30 days.
6. Intellectual Property
All automation workflows, custom code, and marketing strategies developed by 9TOP LLC remain the intellectual property of 9TOP LLC unless a full transfer of rights is explicitly granted in a signed secondary agreement.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey. Any legal actions related to these terms shall be filed in the courts located in Union County, NJ.
8. Changes to Terms
We reserve the right to modify these Terms at any time. Your continued use of our services following any changes constitutes your acceptance of the new Terms.
